Shipping policy
This Shipping Policy explains where we ship, what it costs, how long it takes, and who pays import charges. It forms part of our Terms and Conditions, and Sections 11 and 12 of those Terms govern if anything here is unclear.
1. Where we ship
We ship within the Philippines and internationally to the destinations offered at checkout. If your country does not appear at checkout, please send us an email at info@tabaqueria.com so we may arrange shipment to you or direct you to our distributor in your jurisdiction.
We may decline an international order where we reasonably believe the shipment would be unlawful or materially impracticable.
2. Within the Philippines
Shipping is free, and orders usually arrive within 1 to 3 business days. We deliver nationwide.
Prices for delivery within the Philippines include 12% VAT.
3. International shipping
International orders are sent by courier. The charge is calculated by weight and is shown at checkout before you pay, so there is nothing to work out afterwards.
Transit times vary by destination. Customs inspection can add to them, and we cannot predict how long a particular customs office will take.
4. Duties, taxes and customs charges
Prices at checkout DO NOT INCLUDE LOCAL DUTIES AND TAXES that your customs office may charge.
Tabaqueria De Filipinas Inc. is NOT RESPONSIBLE FOR PAYING IMPORT DUTIES AND TAXES. Destination-country customs duties, import taxes, excise taxes, brokerage charges, clearance fees, permits and other government charges are the recipient's responsibility.
We do not collect these charges, and we cannot tell you in advance what your country will charge. We recommend checking with your local customs office before you order.
5. Import rules are your responsibility
Tobacco importation is regulated differently in every country. Some prohibit it outright, some cap the quantity a private individual may receive, and some require a permit.
Before placing an international order, please satisfy yourself that you may lawfully purchase, import, possess and receive the products and quantities you are ordering at the destination. You are also responsible for giving us the information reasonably needed for customs clearance.
If a shipment is detained, refused, returned, destroyed or confiscated because importation is prohibited or restricted at the destination, because a required permit or authorisation is missing, because lawful duties or charges were not paid, because inaccurate customs or delivery information was supplied, or because destination-country requirements were otherwise not met, we will not be responsible for the resulting loss, and amounts paid may be non-refundable to the extent permitted by law.
That exclusion does not apply where the problem was caused by our own error, our unlawful act, a material misdescription by us, or our failure to perform an obligation the law places on us. Mandatory consumer protections that apply in your country are not excluded.
6. Delivery times are estimates
Delivery dates and transit times are estimates, not guarantees, unless we have expressly guaranteed them to you in writing.
Delays can arise from weather, courier operations, customs processing, regulatory inspection, events outside our reasonable control, incomplete address information, or the recipient being unavailable.
We remain responsible for the obligations the law places on us even though a third-party courier carries the parcel.
7. Your address and failed deliveries
Please give us a complete and accurate delivery address and contact number.
If delivery fails because the address you supplied was incorrect or incomplete, because you did not collect or accept the parcel after reasonable attempts, because you refused delivery without a valid reason, or because of another circumstance within your control, we may, to the extent the law permits, ask you to pay the reasonable actual cost of redelivery before we try again, treat the parcel as undeliverable, or deduct reasonable return or redelivery costs from any amount otherwise refundable.
Because tobacco products returned through the delivery chain may not be suitable for resale, a failed delivery caused by the customer does not automatically entitle the customer to a refund. Your mandatory consumer rights are unaffected.
8. Age verification on delivery
Our products may be sold only to adults: at least 18 years old, or older where the law in your jurisdiction or the jurisdiction where the order is delivered sets a higher minimum age for buying tobacco.
We may ask for proof of age or identity at any point before delivery, and a courier may do the same before releasing a parcel. Please do not arrange delivery to a minor or ask a minor to accept a parcel on your behalf.
9. Lost, damaged or defective shipments
If a parcel is lost before delivery and the loss is not your fault, contact us. We will investigate with the carrier and provide the remedy required by law, which may include replacement or refund. A shipment is not treated as lost simply because it is delayed in customs or carrier processing.
If your order arrives damaged or defective, please tell us within 48 hours of delivery, where you reasonably can, with photographs of the cigars, the packaging and the shipping label. The forty-eight-hour (48-hour) request is an administrative claim-handling procedure. Failure to report within forty-eight hours does not extinguish a statutory right or remedy that cannot lawfully be waived. Full details are in our Return and Refund Policy.
